Terms of Service

1. Acceptance of Terms

By creating an account or otherwise using the AI Story App (the "Service") operated by Heavy Gold LLC ("Company," "we," "us," or "our"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Service Description

The Service uses artificial-intelligence models to generate and share short audio stories for children. Users (typically parents or legal guardians) may request stories, listen to them, and share them via links or embeddable players.

3. Eligibility & Children's Use

The Service is intended for use by parents or legal guardians, not directly by children under 13. You must be at least 18 (or the age of majority in your jurisdiction) to open an account. You may allow your child to listen to stories you create, provided you supervise such use at all times.

4. Accounts & Security

You are responsible for all activity that occurs under your credentials. Keep your password confidential and notify us immediately of any unauthorized use.

5. User Content & AI-Generated Content

  • "User Content" means text prompts, images, recordings, or other materials you submit.
  • You retain any ownership you hold in User Content.
  • You grant us a worldwide, non-exclusive, royalty-free license to host, reproduce, adapt, publish, and publicly perform User Content solely to provide and improve the Service.
  • AI-generated stories may be unique or may resemble existing works due to training data. We do not guarantee exclusivity or copyright ownership of generated content.

6. Intellectual Property

Except for User Content, the Service and all materials therein are owned by us or our licensors and are protected by copyright, trademark, and other laws. We grant you a personal, non-transferable, non-sublicensable license to access and use the Service for non-commercial, family-oriented purposes.

7. Fees & Payments (if applicable)

Certain features may require payment. All fees, if any, will be disclosed before purchase and are non-refundable except as required by law.

8. Prohibited Conduct

You agree not to:

  1. Submit prompts or content that is illegal, hateful, sexually explicit, or otherwise inappropriate for children.
  2. Attempt to reverse engineer or interfere with the AI models or Service infrastructure.
  3. Collect or harvest personal information of other users.
  4. Use the Service to create defamatory or infringing content.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. AI-GENERATED STORIES MAY CONTAIN ERRORS OR INACCURACIES.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED US$100. WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES.

11. Indemnification

You agree to indemnify and hold us harmless from any claims arising from your misuse of the Service or violation of these Terms.

12. Termination

We may suspend or terminate your account at any time for violation of these Terms or to protect the Service or its users.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of New York, USA, without regard to conflict-of-law principles. Any dispute shall be resolved by binding arbitration in New York County under the rules of the American Arbitration Association, except that either party may seek injunctive relief in court.

14. Changes to Terms

We may modify these Terms at any time. Material changes will be posted in the app or emailed to you. Continued use after changes constitutes acceptance.
